Terms and Conditions
1. About the App
The App is a tool that helps you prepare and export IRS Form W-9 (Request for Taxpayer Identification Number and Certification). It is published by Essential Dev Team ("we", "us", "our") and distributed through the Apple App Store.
2. Not tax or legal advice
The App is a form-preparation tool only. It does not provide tax, legal, accounting, or financial advice. The accuracy and legal sufficiency of any W-9 you create with the App are your sole responsibility. If you are unsure how to complete a W-9 — including which tax classification to choose, which exempt payee codes apply, or whether you are subject to backup withholding — please consult a qualified tax professional or visit irs.gov.
3. Your responsibility for accuracy
Form W-9 is signed under penalty of perjury. You are solely responsible for:
- The accuracy and completeness of every field you enter (including your name, business name, classification, address, SSN/EIN, and signature)
- Reviewing the rendered PDF before exporting or sending it
- Confirming the form you generate meets the requirements of the requester and current IRS rules
- Choosing how, when, and to whom you deliver the completed W-9
4. License to use the App
Subject to your compliance with these Terms and the Apple App Store Terms of Service, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, for your own form-preparation purposes. You may not redistribute the App, reverse-engineer it (except to the extent permitted by applicable law), or use it to provide commercial form-filling services to third parties without our written consent.
5. In-app purchases
The App includes an in-app purchase that unlocks PDF export ("Unlock"). The Unlock is a one-time non-consumable purchase tied to your Apple ID. Purchases are processed by Apple via the App Store. All sales are final, except as required by applicable consumer law or the Apple App Store refund policy. Refund requests should be directed to Apple through reportaproblem.apple.com.
6. No warranty
The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the App will be uninterrupted or error-free. We do not warrant that any W-9 generated by the App will be accepted by the IRS, by any requester, or by any third party.
7. Limitation of liability
To the maximum extent permitted by applicable law, in no event will Essential Dev Team or its developers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, goodwill, data, business, or anticipated savings, arising out of or in connection with your use of (or inability to use) the App, even if advised of the possibility of such damages. Our total aggregate liability for all claims arising out of or relating to the App will not exceed the amount you actually paid (if any) for the App and its in-app purchases in the twelve (12) months preceding the claim, or USD $20, whichever is greater.
8. Your conduct
You agree not to:
- Use the App to commit fraud or to misrepresent your identity or tax status
- Enter another person's information without their knowledge and authorization
- Use the App in any way that violates applicable law
- Interfere with or attempt to circumvent the App's in-app purchase or licensing mechanisms
9. Intellectual property
All intellectual property rights in the App (excluding the IRS Form W-9 itself, which is a public U.S. Government work) belong to Essential Dev Team. These Terms do not transfer any rights to you other than the limited license described above.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The App runs entirely on your device and does not transmit your data to us.
11. Apple terms
You acknowledge that these Terms are between you and Essential Dev Team, not Apple, and that Apple is not responsible for the App or its content. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. You also agree to comply with all applicable Apple App Store Terms of Service, available at apple.com/legal/internet-services/itunes.
12. Termination
These Terms remain in effect until terminated. You may terminate by deleting the App from your device. We may suspend or terminate your right to use the App if you materially breach these Terms. Sections 2, 3, 6, 7, 9 and 13 survive termination.
13. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Any dispute arising from these Terms will be resolved exclusively in the state or federal courts located in Delaware, unless applicable consumer-protection law in your country grants you the right to bring a claim in your local courts.
14. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted at this URL, with the "Last updated" date above. Continued use of the App after an update means you accept the revised Terms.
