By downloading, installing, or using CDL Exam Prep ("the App"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.
CDL Exam Prep is a mobile application designed to help users prepare for the Commercial Driver's License (CDL) written exam. The App provides practice questions, timed mock exams, progress tracking, spaced repetition review, and study analytics across four CDL endorsement categories: General Knowledge, Air Brakes, Combination Vehicle, and Hazardous Materials.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, as permitted by the Apple App Store Terms of Service.
You agree not to:
All content in the App — including but not limited to questions, explanations, answer text, graphics, diagrams, icons, user interface design, and software code — is the exclusive property of CDL Exam Prep and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any App content without prior written consent.
CDL Exam Prep is a study aid and educational tool only. We do not guarantee that using the App will result in passing the CDL exam.
The App is not affiliated with, endorsed by, or sponsored by any state Department of Motor Vehicles (DMV), the Federal Motor Carrier Safety Administration (FMCSA), or any government agency. CDL exam requirements, passing scores, and question formats may vary by state and may change over time.
You are solely responsible for verifying current exam requirements with your local DMV or licensing authority.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL CDL EXAM PREP, ITS DEVELOPERS, OFFICERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless CDL Exam Prep and its developers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App or your violation of these Terms.
The App uses Apple's StoreKit framework to process in-app purchases and subscriptions. Your use of in-app purchases is also subject to Apple's Licensed Application End User License Agreement (EULA).
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is immediately revoked.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and CDL Exam Prep regarding the use of the App, and supersede all prior agreements and understandings.
