Please read these Terms and Conditions ("Terms") carefully before using the SafeGuard mobile application ("App", "Service") operated by Essential Dev Team ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Overview of the Service
SafeGuard is a personal communication tool that allows you to:
- Create pre-written legacy messages and designate contacts to receive them.
- Set a check-in timer so that if you fail to check in within your chosen interval, your pre-written messages are emailed to your designated contacts.
- Use a Silent Distress feature that, when activated via a secret PIN, silently sends a customizable SOS email (optionally including your GPS location) to your chosen emergency contacts.
The App facilitates email-based notifications to contacts you designate. It does not interact with, replace, or connect to any government emergency service, law enforcement agency, or first responder system.
2. Critical Safety Disclaimer
SAFEGUARD IS NOT AN EMERGENCY SERVICE. The App does not contact, connect to, or replace 911, police, fire departments, ambulance services, or any other government emergency response system.
If you are in immediate danger, always call 911 (or your local emergency number) first.
SafeGuard is a supplemental personal communication tool only. It sends emails to private individuals you have designated. Those individuals are not obligated to act on the messages they receive, and we have no control over whether, when, or how they respond.
You must never rely on SafeGuard as your sole or primary means of seeking help in an emergency. The App is designed to complement, not replace, direct calls to emergency services.
We do not monitor, review, or act upon any messages, SOS alerts, or check-in activity within the App. We do not dispatch any form of assistance.
3. No Guarantee of Message Delivery
SafeGuard depends on multiple third-party systems to deliver messages, including but not limited to internet connectivity, cellular networks, cloud hosting services, and third-party email delivery providers. As a result:
- We do not guarantee that any message, SOS alert, or notification will be delivered successfully, completely, or in a timely manner.
- We do not guarantee that the App will be available, operational, or free from errors at all times.
- Email messages may be filtered, delayed, blocked, or directed to spam or junk folders by the recipient's email provider.
- GPS location data included in SOS alerts depends on your device's location services, signal strength, and hardware. Location accuracy is not guaranteed.
- The check-in timer and deadline system depend on server-side processes. While we strive for reliability, we cannot guarantee that the system will detect a missed check-in or trigger message delivery within any specific timeframe.
4. User Responsibilities
By using SafeGuard, you accept the following responsibilities:
- Your Own Safety. You are solely responsible for your personal safety.
- Accurate Information. You are responsible for providing accurate and current contact information for your designated recipients.
- Recipient Consent. You must ensure that your designated contacts consent to receiving messages and SOS alerts from you through the App.
- Message Content. You are solely responsible for the content of all messages you create. Messages must comply with all applicable laws.
- Account Security. You are responsible for maintaining the confidentiality of your account credentials, normal PIN, and distress PIN.
- Check-In Management. If you activate the check-in timer, you are responsible for checking in within your chosen interval. Once messages are sent, they cannot be unsent or recalled.
- Periodic Review. You should periodically review and update your messages, contacts, and settings.
5. Acceptable Use
You agree not to use the App to:
- Send false, misleading, or fraudulent emergency alerts.
- Harass, stalk, threaten, or intimidate any person.
- Violate the privacy of any individual.
- Distribute spam, malware, or harmful content.
- Reverse engineer, decompile, or disassemble the App.
- Circumvent any security features of the App.
- Violate any applicable law.
- Impersonate any person or entity.
6. Subscription Terms
- Free Tier. SafeGuard offers a free tier with limited features, including restrictions on the number of contacts, messages, and check-in intervals.
- Premium Subscription. SafeGuard Premium is available in weekly, monthly, and yearly billing periods with expanded features.
- Billing. Subscriptions are billed through Apple's App Store using your Apple ID. The price is displayed before purchase and charged at confirmation.
- Auto-Renewal. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
- Cancellation. You may cancel at any time through your Apple ID account settings. No refunds are provided for partial billing periods.
- Refunds. Refund requests are handled by Apple in accordance with Apple's refund policies.
- Effect of Cancellation. Your account reverts to the free tier. Premium features become unavailable.
7. Intellectual Property
The App and its original content, features, and functionality are the exclusive property of Essential Dev Team, protected by copyright, trademark, and other applicable laws.
8. Privacy and Data Handling
- Data We Collect. We collect your email address, contacts' names and emails, message content, check-in timestamps, and (if enabled) GPS coordinates during SOS events.
- How We Use Data. Your data is used solely to operate the Service. We do not sell your personal data to third parties.
- Third-Party Services. The App uses Supabase (database/auth) and Resend (email delivery). These services process your data per their own privacy policies.
- Data Security. We implement reasonable measures to protect your data. However, no method of electronic storage is 100% secure.
- Data Retention. Your data is retained while your account is active. You may request deletion at any time.
- Sensitive Data. You acknowledge that legacy messages and emergency contact information are highly personal. You accept the inherent risks of storing such information digitally.
9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MESSAGES WILL BE DELIVERED SUCCESSFULLY. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Essential Dev Team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to:
- Failure or delay in delivering messages or SOS alerts
- Missed check-ins due to malfunction or user error
- Inaccurate GPS location data
- Unauthorized access to your data
- Any personal injury, harm, or loss arising from reliance on the App
- Actions or inactions of your designated contacts
- Service interruptions or data loss
Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is less.
11. Indemnification
You agree to indemnify and hold harmless Essential Dev Team from any claims, liabilities, damages, losses, and expenses arising from your use of the App, the content of your messages, your violation of these Terms, or your violation of any third-party rights.
12. Age Requirements
You must be at least 18 years of age to create an account and use SafeGuard. By using the App, you represent that you meet this requirement. We do not knowingly collect information from individuals under 18.
13. Termination
- By You. You may stop using the App and delete your account at any time. Deleting the App does not automatically cancel your subscription.
- By Us. We may suspend or terminate your account at any time for violation of these Terms or conduct harmful to others.
- Effect. Upon termination, your right to use the App ceases. We may delete your data. Pending message deliveries may not be processed.
14. Changes to Terms
We may revise these Terms from time to time. Material changes will be notified through the App. Continued use after changes constitutes acceptance. If you disagree, you must stop using the App.
15. Governing Law
These Terms shall be governed by the laws of the State of Delaware, United States. Any disputes shall first be attempted through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration. You agree to waive any right to class action proceedings.
